01. Engagement Overview

By accessing the Swiftly Digital interface or engaging in our professional services, you agree to be bound by these Terms of Service. These terms govern the digital collaboration between the Agency and the Client.

02. Intellectual Property

The distribution of ownership is defined as follows:

• Agency Rights: Swiftly Digital retains ownership of all preliminary sketches, unused concepts, and underlying methodologies used during the creative process.
• Client Rights: Upon final payment, the Client is granted full ownership of the final delivered assets for their intended commercial use.
• Portfolio Credit: The Agency reserves the right to display completed work within its professional portfolio and marketing channels.

03. Client Obligations

The Client agrees to provide timely feedback and necessary assets (content, imagery, brand guidelines) required for project progression. Delays in feedback may result in the rescheduling of project delivery dates.

04. Limitation of Liability

Swiftly Digital provides high-end creative solutions. However, we do not guarantee specific financial outcomes or market performance. The Agency shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services.

05. Governing Law

These terms are governed by the laws of the State of Colorado, United States. Any disputes shall be resolved within the jurisdiction of the courts located in Colorado Springs.
